LeadsOnline, LLC and its other legal entities ("LeadsOnline," "we," "us," "our") respects the privacy rights of individuals ("you" and "your") and is committed to handling Personal Data responsibly and in accordance with applicable laws and regulations. This Privacy Notice ("Notice") describes how LeadsOnline collects, uses, discloses, transfers, and stores your Personal Data, and the rights you have in connection with that data.
This Notice applies to your interactions with LeadsOnline and the LeadsOnline Products and services referenced herein, including our websites, conferences and events, mobile applications, and digital assets that display this Notice. When you access or use such services, you acknowledge that you have read this Notice and understand its contents.
Our privacy practices may vary among the countries in which we operate to reflect local practices and legal requirements. Specific privacy policies may apply to some of our products or services. Please visit the relevant webpage, mobile application, or digital asset to learn more.
Definitions
"LeadsOnline Cloud Services" means LeadsOnline's web services hosted on leadsonline.com, including CellHawk, Nighthawk, LeadSuite, Real Time Crime, and other related offerings, including interactions between LeadsOnline Cloud Services and LeadsOnline Products (as defined below).
"LeadsOnline Products" means:
- LeadsOnline Cloud Services;
- Devices or equipment sold by LeadsOnline (including ClearCase, BrassTrax, BulletTrax, Matchpoint, and Quantum equipment) (collectively, "LeadsOnline Devices");
- Other software offered by LeadsOnline, including LeadsOnline mobile applications; and
- Ancillary hardware, equipment, software, services, cloud-based services, documentation, and software maintenance releases and updates.
"Data Controller" means the natural or legal person, public authority, or other body that, alone or jointly with others, determines the purposes and means of the processing of Personal Data.
"Data Processor" means a natural or legal person, public authority, agency, or other body that processes personal data on behalf of the Data Controller.
"Personal Data" means information relating to an identified or identifiable natural person that would allow that person to be identified directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or factors specific to that person's physical, physiological, genetic, mental, economic, cultural, or social identity.
"Processing" means any operation or set of operations performed on Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, disclosure, dissemination, alignment, restriction, erasure, or destruction.
"Sensitive Personal Data" means personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership; genetic data; biometric data processed for the purpose of uniquely identifying a natural person; data concerning health; or data concerning a natural person's sex life or sexual orientation.
"Sub-processor" means a natural or legal person, public authority, agency, or other body that acts under the instructions of the Data Processor and may process individuals' personal data on behalf of the Data Processor.
"Supervisory Authority" means the relevant independent public authority established pursuant to applicable privacy law.
What Personal Data We Collect
LeadsOnline may collect and process the following types of Personal Data:
- Contact Information and Identifiers. Your name, postal address, email address, social network details, or phone number.
- User Profile and Account Data. Information you provide when registering for events, creating or updating an account, or purchasing products or services. This may include name, email address, phone number, login credentials, postal address, payment or banking information, order history, account preferences, usage information, and administrative account details.
- Transaction Data. Information collected when you purchase products or services, including account number, transaction date and amount, type of product purchased, and information provided by financial institutions to process your transaction.
- Communication Data. Information collected when you communicate with us, including email content, SMS messages, chatbot interactions, calendar invitations, photos, videos, and group affiliations. If you opt-in to receive SMS/text messages from us, we will use your mobile number and your opt-in consent only to provide the messages you requested, provide customer support, seek customer feedback, and to comply with applicable law. We do not sell, rent, or share your mobile opt-in information (including your phone number and SMS consent) with any third parties for their marketing or promotional purposes.
- Support Data. Information collected when you contact us for support, including hardware/software details, contact authentication information, machine condition data, application fault details, diagnostic and registry information, and error tracking files.
- Demographic Data. Specific personal and sensitive personal data types including age range, socio-economic status, or similar data, that provide generalized insights.
- Behavioral Data. Data reflecting how you interact with LeadsOnline, such as website visits, video views, web form downloads, or e-commerce transactions.
- Consumer-Generated Data. Information you create and share with us on third-party social networks or by uploading to our websites or apps, such as photos, videos, or personal stories.
- Sensitive Personal Data. We do not seek to collect or process Sensitive Personal Data in the ordinary course of business. Where processing is necessary, we rely on your prior express consent (where required by law), or on the following legal bases where applicable: (i) detection and prevention of crime, including fraud; and (ii) compliance with applicable laws and regulations.
How Your Personal Data Is Used
LeadsOnline may use your Personal Data to:
- Create and manage your account, verify your identity, and respond to your inquiries;
- Manage our relationship with you, including sending administrative information about changes to our terms, conditions, and policies;
- Enable you to purchase products or services, process transactions, communicate about purchases, and provide customer service;
- Provide, update, secure, troubleshoot, and support our products and services, and share information as required to carry out requested transactions;
- Understand customer preferences and characteristics to personalize our products, services, and recommendations;
- Market our products or services and track advertising effectiveness, including sending promotional communications and targeted advertisements — unless you have opted out or we have not obtained required consent;
- Administer and communicate about surveys, contests, conferences, or similar events;
- Operate, evaluate, and improve our business;
- Comply with applicable laws;
- Enforce our policies, terms, and conditions, and establish, exercise, or defend legal rights;
- Protect against security threats, fraud, and other risks;
- Protect the rights, privacy, safety, security, and property of LeadsOnline, its affiliates, and others;
- Deliver event services, tailor sessions to audience profiles, and review outcomes of past events to plan future ones; and
- Better understand event attendee needs and interests to improve our products and services.
SMS Communications
SMS Two-Factor Authentication
LeadsOnline may use an SMS/text message service to send one-time verification codes as part of a two-factor authentication (2FA) process to help secure your account.
Consent and Opt-In. Participation in SMS 2FA is consent-based. By enabling or activating the 2FA feature in your account settings, you are consenting to receive SMS verification codes from LeadsOnline. Your consent is not a condition of purchasing any product or service.
Purpose Limitation. SMS messages sent for 2FA purposes are used solely for account security. They will not be used for marketing, promotional, or any other unrelated purpose.
Opt-Out. You may opt out of SMS 2FA at any time by disabling the feature in your account settings or by replying STOP to any SMS message sent by LeadsOnline. You may also revoke consent through any other reasonable means, including by emailing privacy@LeadsOnline.com, calling our support line, or submitting a request through our website. We will honor opt-out requests as promptly as practicable. Reply HELP to any SMS message for assistance. Please note that disabling 2FA may reduce the security of your account. To continue accessing certain features or services, you may be required to enable and use an alternative multi-factor authentication or comparable security measure.
Message and Data Rates. Standard message and data rates may apply depending on your mobile carrier and plan. Message frequency varies. LeadsOnline is not responsible for any charges incurred from your carrier.
SMS Marketing and Transactional Communications
LeadsOnline may also send other SMS/text messages to you, including transactional messages (such as account notifications and customer support responses) and marketing or promotional messages as permitted by law.
Consent and Opt-In. Before sending you marketing or promotional text messages, LeadsOnline will obtain your prior express written consent. When requesting your consent, we will clearly disclose: (a) that you are agreeing to receive automated marketing text messages from LeadsOnline; (b) that consent is not a condition of purchasing any product or service; (c) the approximate frequency of messages; and (d) how to opt out. Transactional and informational messages (such as account alerts, order confirmations, and customer support responses) may be sent based on prior express consent or our existing relationship with you, consistent with applicable law.
Opt-Out. You may revoke your consent to receive SMS messages from LeadsOnline at any time. We will honor opt-out requests made through any reasonable means, including by replying STOP to any LeadsOnline SMS message, by emailing privacy@LeadsOnline.com, by calling our support line, or through our website. We will honor opt-out requests as promptly as practicable. Following an opt-out, we may send a single confirmation message with no promotional content. Standard message and data rates may apply.
Time Restrictions. LeadsOnline will not send marketing or promotional SMS messages outside of hours permitted by applicable law.
LeadsOnline complies with all applicable federal and state laws governing commercial text messaging, including requirements relating to prior express written consent, time-of-day restrictions, message frequency limits, and do-not-call or do-not-text registry obligations. The specific requirements that apply to you may vary based on your location.
No Sale or Misuse of Contact Information
LeadsOnline does not sell, rent, or trade your contact information — including phone numbers and email addresses — to third parties for their own marketing or commercial purposes. This practice applies regardless of how such information was collected.
Any use of call or text applications by LeadsOnline employees is limited to internal business operations and direct customer communication purposes only.
LeadsOnline Conferences
LeadsOnline collects Personal Data when you register for and attend our conferences. In addition to the general information described in this Notice, the following applies to conference attendees:
Photography/Video/Audio. LeadsOnline and its affiliates may photograph, videotape, audiotape, or webcast meetings and activities in public areas of the conference (session rooms, exhibit halls, etc.). This media may be used for informational, publicity, promotional, and/or reporting purposes in print or electronic communications. Your image and voice may be recorded and, if you are identified or identify yourself by name, that information may be included. Recordings may be edited, copied, exhibited, published, or distributed. Attendees who do not wish to be photographed or recorded should notify a LeadsOnline staff member at the event.
Badge Scanning by Exhibitors. Exhibitors may wish to scan your badge to follow up with more information. By allowing an exhibitor to scan your badge, you are consenting to LeadsOnline sharing your registration data (such as name and contact details) with that exhibitor. You may then be contacted by the exhibitor after the event. If you do not wish to be contacted, please communicate this directly to the exhibitor at the event or thereafter.
RFID. LeadsOnline may use RFID technology in conference badges to understand attendee journeys, including session attendance, exhibit floor visits, and event activities. This information helps event managers better understand attendee interests. Attendees who do not wish to use a RFID-enable badge at these events may request a non-RFID badge at registration.
Information Sharing
Affiliated Businesses and Event Sponsors
LeadsOnline is affiliated or partnered with a variety of businesses and may jointly market or sell products or services with those businesses. Some of our events are also sponsored, and LeadsOnline may provide an attendee list to sponsors, co-sponsors, and exhibitors. Your mobile opt-in information (including your phone number and SMS consent) will not be shared with affiliated businesses, sponsors, co-sponsors, or exhibitors for any purpose.
If you do not wish to have your Personal Data shared with affiliated businesses, or included in an attendee list, you may opt out when registering for an event or by emailing privacy@LeadsOnline.com.
Service Providers and Agents
LeadsOnline may engage third-party companies and individuals to perform services on our behalf. We only share Personal Data with third parties when necessary to provide products or services to you. Any third party acting as an agent or service provider must enter into a written agreement that protects your information from unauthorized disclosure or misuse. Third-party service providers are prohibited from using your Personal Data for purposes beyond those specified in their agreement with LeadsOnline.
Promotional Offers
LeadsOnline may send promotional offers on behalf of third-party business partners. If you do not wish to receive such offers, you may opt out through the unsubscribe option in the offer, or by emailing privacy@LeadsOnline.com.
Such promotional offers from our partners will be delivered only via channels for which you have provided consent. We will not use your mobile opt-in information (including your phone number and SMS consent) to send promotional offers on behalf of third-party partners, and we will not share that information with such partners for their own marketing or promotional purposes.
Other Permitted Disclosures
Except as described in this Notice, LeadsOnline will not share your Personal Data with third parties without your permission, unless:
- Required to respond to duly authorized information requests from law enforcement or governmental authorities;
- Required to comply with any applicable law, regulation, subpoena, or court order;
- Necessary to investigate and help prevent security threats, fraud, or other malicious activity;
- Necessary to enforce or protect the rights and properties of LeadsOnline or its subsidiaries; or
- Necessary to protect the rights and personal safety of LeadsOnline employees and third parties using LeadsOnline Products.
Data Retention
LeadsOnline retains Personal Data only for as long as necessary for the specific purpose for which it was collected, or as otherwise required by applicable laws or regulations. Retention periods vary depending on the type of data and the purpose for which it was collected. Keeping Personal Data Secure
LeadsOnline is committed to protecting your Personal Data. We have implemented administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and security of Personal Data against unauthorized access, use, modification, disclosure, and misuse. These safeguards include:
- Encryption. Personal Data is protected using industry-standard encryption protocols in transit and appropriate encryption controls at rest.
- Access Controls. Access to Personal Data is restricted on a need-to-know basis. Employees and contractors are granted access only to the data necessary to perform their job functions.
- Incident Response. LeadsOnline maintains an incident response plan to promptly detect, contain, and remediate security incidents involving Personal Data.
Our information security program includes specific security requirements for personnel and all sub-processors or agents who have access to Personal Data. LeadsOnline maintains a security awareness training program to ensure employees understand and fulfill their security obligations.

Your Data Subject Rights
Depending on your location, you may have the following rights regarding your Personal Data:
- Access — Request access to and a copy of the Personal Data we hold about you;
- Correction — Request that we correct inaccurate or incomplete Personal Data;
- Deletion — Request that we delete or stop processing your Personal Data where it is no longer necessary for the purposes for which it was collected;
- Objection — Object to processing based on our legitimate interests;
- Withdrawal of Consent — Withdraw your consent at any time where consent is the legal basis for processing; and
- Portability — Where applicable, request that your Personal Data be provided in a portable format.

If you believe LeadsOnline has not complied with your data protection rights, you may have the right to lodge a complaint with a supervisory authority in your jurisdiction.
If your Personal Data is to be used for a materially new purpose or disclosed to a non-agent third party in a manner not specified in this Notice, LeadsOnline will provide you with an opportunity to choose whether your data may be so used or disclosed. Opt-out requests may be sent to privacy@LeadsOnline.com.
Sensitive Personal Data will not be used for purposes beyond those for which it was originally collected unless we have received your affirmative and explicit (opt-in) consent.
California Privacy Rights (CCPA/CPRA)
Scope. This section applies to California residents and supplements the rest of this Notice. It does not apply to our employees, job applicants, or processing performed within LeadsOnline Cloud Services governed by separate terms or notices.
Notice at Collection. We collect the categories of personal information described in this Notice for the business and commercial purposes stated herein. We retain personal information for as long as necessary for these purposes or as required by law. We do not sell or share personal information as those terms are defined under California law. We do not use or disclose Sensitive Personal Information for purposes that would require a right to limit, unless otherwise stated.
Your California Rights. California residents have the right to:
- Know and access specific types of Personal Data we hold about them;
- Request deletion of Personal Data;
- Request correction of inaccurate Personal Data;
- Opt out of the "sale" or "sharing" (for cross-context behavioral advertising) of Personal Data;
- Limit the use and disclosure of Sensitive Personal Information where applicable; and
- Not be discriminated against for exercising these rights.

Authorized Agents. To make a request on behalf of a California resident, please use the submission methods noted above and provide a copy of the consumer's written authorization designating you as their agent.
Nondiscrimination. We will not unlawfully discriminate against you for exercising your rights under the CCPA/CPRA.
Texas Privacy Rights (TDPSA)
Scope. This section applies to Texas residents and supplements the rest of this Notice. It does not apply to our employees, job applicants, or processing performed within LeadsOnline Cloud Services governed by separate terms or notices.
Notice at Collection. We collect the categories of personal data described in this Notice for the business and commercial purposes stated herein. We retain personal data for as long as necessary for these purposes or as required by law. We do not sell personal data or process personal data for targeted advertising as those terms are defined under Texas law.
Your Texas Rights. Texas residents have the right to:
- Know and confirm whether LeadsOnline is processing personal data about them and to access that data;
- Request correction of inaccurate personal data;
- Request deletion of personal data provided by or obtained about them;
- Obtain a copy of personal data previously provided to LeadsOnline in a portable and readily usable format;
- Opt out of the processing of personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects; and
- Not be discriminated against for exercising any of the above rights.
How to Exercise Your Rights. To submit a rights request, please contact us at privacy@LeadsOnline.com or by mail at LeadsOnline, LLC, Attn: Privacy, 6900 Dallas Parkway, Suite 825, Plano, TX 75024. LeadsOnline will respond to verified requests within 45 days of receipt, as required by the TDPSA. If additional time is needed, we will notify you within the initial 45-day period and may extend our response by an additional 45 days.
Appeals. If LeadsOnline declines to take action on your request, you may appeal that decision by contacting us at privacy@LeadsOnline.com with the subject line "TDPSA Appeal." We will respond to your appeal within 60 days. If your appeal is denied, you may submit a complaint to the Texas Attorney General at https://www.texasattorneygeneral.gov.
GDPR – Additional Information for EEA, U.K., and Swiss Individuals
Where the General Data Protection Regulation (GDPR) or equivalent national implementing legislation applies — including in connection with LeadsOnline Products deployed in the European Economic Area — LeadsOnline processes Personal Data in accordance with the following principles:
Roles. Depending on the context, LeadsOnline may act as a Data Controller (where it determines the purposes and means of processing) or as a Data Processor (where it processes Personal Data on behalf of a customer or partner). Where LeadsOnline acts as a Data Processor, processing is governed by an agreement with the relevant Data Controller.
Lawful Basis. LeadsOnline processes Personal Data only where it has a lawful basis to do so, as described in the "Legal Basis for Processing Personal Data" section below. We do not process Personal Data for purposes incompatible with those for which it was originally collected without your consent or another applicable legal basis.
Data Minimization and Purpose Limitation. We collect only the Personal Data that is adequate, relevant, and necessary for the purposes described in this Notice, and we do not use it for unrelated purposes without your consent.
International Transfers. Where Personal Data is transferred from the EEA, U.K., or Switzerland to countries not recognized as providing an adequate level of protection, LeadsOnline relies on appropriate safeguards to ensure that your Personal Data receives equivalent protection.
Data Subject Rights. Individuals in the EEA, U.K., and Switzerland have the rights described in the "Your Data Subject Rights" section of this Notice, including the right to lodge a complaint with a relevant Supervisory Authority if you believe your rights have not been respected.

Where required by applicable law, LeadsOnline has designated a data protection contact who can be reached at the same address.
Legal Basis for Processing Personal Data
For individuals in the European Economic Area (EEA), the United Kingdom (U.K.), or Switzerland, our legal bases for collecting and processing your Personal Data are:
- Contractual obligations — to facilitate and process transactions when you interact with LeadsOnline, such as registering for an event or making a purchase;
- Consent — where applicable and required by law; and
- Legitimate interests — to provide and support our products and services; foster customer relationships; grow LeadsOnline's business; ensure you receive relevant communications unless opted out; investigate and help prevent security threats, fraud, or malicious activity; and enforce and protect the rights, properties, and personal safety of LeadsOnline, its affiliates, employees, and third parties; and
- Legal compliance — where required by applicable laws and regulations.
Canada – Additional Information for Canadian Individuals
LeadsOnline collects, uses, and discloses personal information of Canadian individuals in the course of commercial activities, including through the provision of our Products to Canadian customers. These activities are subject to Canada's federal Personal Information Protection and Electronic Documents Act (PIPEDA) and corresponding provincial legal requirements.
Accountability and Privacy Officer. LeadsOnline is accountable for the personal information under its control and has designated a privacy officer responsible for overseeing compliance with applicable Canadian privacy laws. The privacy officer can be reached at privacy@LeadsOnline.com. LeadsOnline's accountability extends to personal information transferred to third-party service providers, who are required by contract to provide comparable levels of protection.
Consent and Identifying Purposes. LeadsOnline identifies the purposes for which personal information is collected at or before the time of collection, as described in this Notice. We obtain consent before or at the time of collection, and do not use or disclose personal information for purposes other than those for which it was collected, except with consent or as required or permitted by law. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting privacy@LeadsOnline.com.
Limiting Collection, Use, and Retention. We collect only the personal information necessary for the identified purposes, by fair and lawful means. Personal information is retained only as long as necessary to fulfill those purposes or as required by law.
Accuracy. LeadsOnline takes reasonable steps to ensure that personal information is accurate, complete, and up-to-date as necessary for the purposes for which it is used. You may request correction of inaccurate or incomplete personal information as described in the "Your Data Subject Rights" section of this Notice.
Individual Access and Rights. Upon request, LeadsOnline will inform Canadian individuals of the existence, use, and disclosure of their personal information and provide access to that information, subject to limited exceptions as permitted by law. Individuals in Quebec may have additional rights, including the right to erasure, de-indexation, data portability. To exercise any of these rights, please contact privacy@LeadsOnline.com. We will respond to access requests as required by applicable law.
Cross-Border Transfers. Personal information collected from Canadian individuals may be transferred to and processed in the United States and other countries where LeadsOnline or its service providers operate. LeadsOnline remains accountable for personal information transferred to third parties and requires, by contract, that such parties provide comparable protection.
Breach Notification. In the event of a breach of security safeguards involving personal information that creates a real risk of significant harm to an individual, LeadsOnline will notify the Office of the Privacy Commissioner of Canada and the affected individual(s) as required by PIPEDA.
Challenging Compliance. You may direct any challenge to LeadsOnline's compliance with applicable Canadian privacy laws to our privacy officer at privacy@LeadsOnline.com.
If You Choose Not to Provide Personal Data
Individuals have no statutory or contractual obligation to provide Personal Data to LeadsOnline. However, if you do not provide information that is necessary for us to deliver a product or service, we may be unable to complete your request. For example, without your name or email address, we cannot register you for a conference or create a user account.
Data Breach Notification
In the event of a data breach that affects your Personal Data, LeadsOnline will notify affected individuals and relevant regulatory authorities in accordance with and within the timeframes required by applicable law. Notification will include information required by applicable law. If you have reason to believe your Personal Data has been compromised, please contact us immediately at privacy@LeadsOnline.com.
Children's Online Privacy Protection
Our products and services are not directed at children under the age of 13, and we do not knowingly collect Personal Data from children under 13. If we learn that we have inadvertently collected Personal Data from a child under 13, we will take prompt steps to delete such information. If you believe we may have collected information from a child under 13, please contact us at privacy@LeadsOnline.com.
Third-Party Sites
LeadsOnline websites may contain links to third-party websites. Such links do not constitute an endorsement of those websites or their services. The privacy and security practices of linked websites are not covered by this Notice, and LeadsOnline is not responsible for their content or practices.
LeadsOnline may also provide social media features that enable you to share information with your social networks. Your use of these features may result in the collection or sharing of information about you by those platforms. We encourage you to review the privacy policies and settings of any social media sites you use.
Cookies and Similar Technologies
Cookies are small text files placed on your device that allow a web server to recognize your device on subsequent visits. LeadsOnline uses cookies and similar technologies to recognize your device, understand how our pages are visited, and personalize the content you view. Cookies placed by LeadsOnline cannot access, read, or modify other information stored on your device.
